If you're not eligible to be removed, tier 1 is the best that you're gonna be in. Now, tier 2 is 37 to 73 points based on your priors and the circumstances of your offense. Finally, if you're over 73 points, this is tier 3, the highest level classification under Megan's Law. The most strict regulations apply here. Now, the County Prosecutor's Office doesn't always get this completely right. You can show us your classification and the points that they assessed based on your original crime and all the other circumstances. I may be able to file what's known as a tier classification appeal. I can try and get the points lowered so that we get you down to a lower tier. This affects whether or not you can live close to a school, whether or not you have to be on the internet registry, and how often you have to check in with the local police.
